Divorce by mutual consent, or amicable divorce, is the simplest, quickest, least costly and above all least painful divorce case for spouses, especially when they have children.

In a divorce by mutual consent there is no conflict, the parties must agree on everything.

Law No. 20016-1547 of November 18, 2016, which came into force on January 1, 2017, relating to the modernization of justice in the 21st century provided for divorce without a judge. The divorce is no longer decided by a judge, but signed by the spouses and their lawyers, by deed of lawyer, then registered by a notary, which will make it enforceable.

Before, the spouses could have the same lawyer or each their own lawyer. Now, each spouse must have a lawyer, in order to verify the free and informed consent of each of the spouses and that no one is harmed.

The divorce without a Judge which diversified the divorce by mutual consent is an extremely rapid divorce since the divorce agreement signed by the spouses and their lawyers, by deed of lawyer, has to be registered by the notary within 15 days. Previously, it took several months to receive a summons from the judge.

The notary does not have to verify the agreement of the spouses who divorce by mutual consent: he does not have to see the lawyers and the parties. He therefore does not have to verify the agreement of the parties, as was the case for the judge.

It is up to the lawyers to verify the agreement of the spouses and not the notary.
